The following document illustrates Websites Built for Less' design policies and Terms and Conditions of Sale. Every Websites Built for Less design client hereby agrees to be bound by the terms stated in this Policy.

Payment Schedule:

The following packages require full payment in advance: Website Brochure Package, 3-Page Website Package, 5-Page Website Package, 6-Page Website Package with Maintenance Tool.

Other packages, including E-Commerce Packages and Custom design or development services, require a non-refundable deposit equal to 50% (Half) of the estimated order total. Balance is due upon completion of the project.

Delinquent bills will be assessed a $30 charge if payment is not received within 14 days of the due date, and Websites Built for Less has the right to suspend ongoing work for the client, until such time that full payment of the outstanding balance has been received. If an amount remains delinquent 30 days after its due date, an additional 5% penalty will be added for each month of delinquency. At this time, Websites Built for Less has the right to replace, modify or remove the Website and revoke the Client's licence of the Work until full payment has been received.  By revoking the Client's licence of the Work or removing the web site from the Internet, Websites Built for Less does not remove the Client's obligation to pay any outstanding balances owed.

Site Design & Approval Guidelines:

Websites Built for Less agrees to provide client with the Website Package of client’s choice, from available layouts as posted on www.websitesbuiltforless.com, presented to the client at time of sale, or as directed by the client (for custom orders). Payment shall be made by cash, check or valid credit card at the time of purchase at the fee set forth on our web site, and as documented in client's Invoice. Once content has been received, the client will generally receive their website within the time frame posted on our website, or relayed to the client on their Invoice. Websites Built for Less shall not incur any liability or penalty for delays in the completion of the project due to actions or negligence of client or external forces beyond the control of the designer. If such event(s) occur, it shall entitle Websites Built for Less to extend the completion/delivery date, by the time equivalent to the period of such delay.

Please review the specifications and options available with each website package. We are specific about what we offer, and each feature's related price. Any additional services requested by the client that are not explicitly listed in each package's details are subject to a charge, as outlined in our Services overview.

On completion of the Work, the Client will be notified and have the opportunity to review it.  The Client should notify Websites Built for Less, in writing, of any unsatisfactory points within 7 days of receipt of such notification.  Any of the Work which has not been reported in writing to Websites Built for Less as unsatisfactory within the 7 day review period will be deemed to have been approved.  Once approved, or deemed approved, work cannot subsequently be rejected, and the contract will be deemed to have been completed and the balancing payment will become due. 

If the Client rejects the Work within the 7 day review period, or will not approve subsequent Work performed by Websites Built for Less to remedy any points reported by the Client as unsatisfactory, and Websites Built for Less considers that the Client is unreasonable in his repeated rejection of the Work, the contract will be deemed to have expired and Websites Built for Less can take any legal measures to recover both payment for the completed Work and reasonable expenses incurred in recovering payment.

Content Submission Guidelines:

The client shall supply all text in digital format (via e-mail or delivered on disc). Websites Built for Less does not edit or check client-submitted content for gramatical errors or spelling; the text you submit to us is the text that will appear on your website.

"One Page" is equivalent to 500 words of text. If client supplies more than 500 words of text for any page of the website, client's order is subject to an additional fee for an "Extra Page", as outlined on our services list. Websites Built for Less is not responsible for editing client-submitted text or questioning the Client's intentions; if you supply the content, we assume you want it on your website as supplied, and will add it and charge accordingly. Please send us your final text. Time required to make changes to client-submitted text after the site has been constructed is subject to additional charges.

Intellectual Property Rights:

Websites Built for Less shall retain all copyrights to the layouts they create to offer to their clients. The client’s purchase of a Website Package through Websites Built for Less shall constitute a NON-TRANSFERRABLE, NON-EXCLUSIVE license to use the layout in perpetuity. In no way shall this license include any Websites Built for Less layout other than the one selected at the time of initial order.

Client hereby acknowledges that all copyrights to stock photos included in Websites Built for Less' designs remain with the original copyright holder. In no way does inclusion of a stock image in client’s website or other marketing piece designed by Websites Built for Less imply a transfer of that license to the client.

Until full payment has been made, Websites Built for Less retains ownership of all original artwork or parts contained therein, whether preliminary or final. Websites Built for Less retains the right to use the completed project and any preliminary designs for the purpose of future publications on design, educational purposes, marketing materials, and portfolio. Where applicable the client will be given any necessary credit for usage of the project elements.

The client represents and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to Websites Built for Less for inclusion in client's website are owned by the client, or that the client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend Websites Built for Less from any claim arising from the use of such elements furnished by the client. Websites Built for Less will not be held liable should the client be found to be infringing on an already existing copyright, trademark or service mark relating to the project name, description or service.

Any code that is not freely accessible to third parties and not in the public domain, and to which Websites Built for Less or their suppliers owns the copyright, may not be copied, published, distributed or passed to any third parties in any form without prior written consent from Websites Built for Less.  Unless previously agreed otherwise in writing, no modifications may be made by the client or any third party to code to which Websites Built for Less or their suppliers owns the copyright.  Websites Built for Less acknowledges the intellectual property rights of the Client.  Information passed in written form to Websites Built for Less, and that the Client has indicated is confidential or a trade secret, will not be published or made available in any other way to third parties without the prior written consent of the Client.

Cancellation Policy:

In the event of cancellation of the project for any reason, ownership of all copyrights and the original artwork and disks shall be returned and retained by Websites Built for Less, and a fee for work completed, based on the contract price and expenses already incurred, shall be paid by the client.

Under NO CIRCUMSTANCES will cash refunds be given. Since we begin work on your website as soon as we receive your initial deposit, all payments are considered NON-REFUNDABLE.

In the event that no communication has taken place between Websites Built for Less and the client for a period of 30 (thirty) calendar days from original Invoice date, the project shall be considered POSTPONED and a fee of $50.00 shall be charged to re-activate the order upon client's request. This charge, in addition to any outstanding balance must be paid in full before work continues.

In the event that no communication has taken place between Websites Built for Less and the client for a period of 60 (sixty) calendar days from original Invoice date, the project shall be considered CANCELLED and a fee for work completed, based on the contract price and expenses already incurred, shall become due and payable.
